On the 7th and 8th November 2011 the Statutory Committee met at 73 University Street, Belfast BT7 1HL for the purpose of making Inquiry into the case and ascertaining the facts in relation to the alleged, of Mr Michael Anthony McMullan registration number 2572R. This hearing was adjourned until 10am on Saturday 26th November 2011 at Society House, 73 University Street, Belfast.
The particulars of the said relevant misconduct are set out hereinafter.
That on various dates on and between 1st January 2005 and 9th April 2008, whilst working as a pharmacist at McMullan Pharmacy, 63 Castle Street, Ballycastle, it is alleged that he:
- Engaged in a practice of inappropriate and excessive dispensing of a Prescription Only Medicine (POM), namely Remedeine Forte to a patient;
- Dispensed Remedeine Forte, a POM containing paracetamol, in such a quantity and with such a frequency that the supply enabled and allowed the patient to exceed the recommended dosage for Paracetamol;
- Dispensed Remedeine Forte in circumstances where he should not have dispensed those quantities;
- Dispensed Remedeine Forte to the said patient in breach of his established Standard Operating Procedures.
And further it is alleged that he:–
- Acted in a manner that calls into question his professional judgment;
- Failed to comply with the following principles and associated obligations of the Pharmaceutical Society of Northern Ireland’s Code of Ethics and Practice:
6.1 Principle 1 – A pharmacist’s prime concern must be for the welfare of both the patient and other members of the public;
6.2. Principle 2 – A pharmacist must uphold the honour and dignity of the profession and not engage in any activity which may bring the profession into disrepute;
6.3. Principle 3 - A pharmacist must at all times have regard to the laws and regulations applicable to a pharmaceutical practice and maintain a high standard of professional conduct. A pharmacist must avoid any act or omission which would impair confidence in the pharmaceutical profession. When a pharmaceutical service is provided, a pharmacist must ensure that it is efficient.
7. By his acts or omissions has (a) brought the profession into disrepute, (b) failed, on a professional basis, to observe the principles set out above and (c) undermined public confidence in the profession.

The Statutory Committee of the Pharmaceutical Society of Northern Ireland will sit at 73 University Street Belfast BT7 1HL on the 27th and 28th of January 2011 at 10.00 am, for the purpose of making Inquiry into the case regarding Mrs. Paula Donnelly a pharmacist registered with the Society, registration number 3339.
It is alleged:
1. That on various dates between 1st March 2007 and 3rd February 2009, whilst working as a Pharmacy Manager at Lloyds Pharmacy, 1 Meeting Street, Magherafelt, she repeatedly and consistently dispensed prescription only medicines to vulnerable adults, who were residents of Hollybank Supported Living, other than in accordance with a prescription in contravention of Section 58 of the Medicines Act 1968.
2. Over the period of approximately 2 years, identified above, she consistently and repeatedly:
a. failed on occasions to ensure that she had in her possession any valid prescription prior to dispensing prescription only medicines;
b. prepared and supplied monitored dosage trays to residents of Hollybank with prescription only medicines relying upon backing sheets and Medical Administration Records without any appropriate contact with the prescriber;
c. amended and adjusted the supply of prescription only medicines given to residents of Hollybank, not by reference to the prescriber but on foot of information given to her by staff working at Hollybank
d. failed to take proper or adequate steps to contact the prescriber to confirm whether the residents of Hollybank should still have had a prescription only medicine dispensed, prior to its supply
e. improperly assumed the roles of both prescriber and dispenser of prescription only medicines
f. failed to maintain and update Patient Medication Records in the pharmacy
g. failed to check the Patient Medication Records prior to dispensing the said prescription only medicines
h. failed to follow the Pharmacy’s established Standard Operating Procedures
i. caused, allowed or permitted prescription only medicines to be supplied to residents of Hollybank which were incorrectly labeled.
3. That as a result of the matters alleged at 1 and 2 above, whether taken individually or cumulatively, she intentionally or recklessly endangered patient safety.
4. Failed to comply with the principles of the Pharmaceutical Society of Northern Ireland's Code of Ethics and Practice and with the associated obligations;

The Statutory Committee of the Pharmaceutical Society of Northern Ireland will sit at 73 University Street Belfast BT7 1HL on the 27th and 28th of January 2011 at 10.00 am, for the purpose of making Inquiry into the case regarding Mr. William Greer a pharmacist registered with the Society, registration number 4076.
It is alleged:
1. That on various dates on or between 2nd February 2009 and 29th April 2009, whilst working as a Pharmacy Cluster Manager at Lloyds Pharmacy, 1 Meeting Street, Magherafelt, he dispensed prescription only medicines to vulnerable adults, who were residents of Hollybank Supported Living, other than in accordance with a prescription in contravention of Section 58 of the Medicines Act 1968.
2. Over the period of approximately 3 months, identified above, he:
a. failed on various occasions to ensure that he had in his possession any valid prescription prior to dispensing prescription only medicines;
b. prepared and supplied, or supervised the preparation and supply of, monitored dosage trays on at least 5 occasions to residents of Hollybank with prescription only medicines without any, or any appropriate, contact with the prescriber;
c. caused, allowed or permitted the supply of prescription only medicines without there being a valid prescription when it was or ought to have been clear to him that relevant prescriptions had not been seen by any of the staff in the Pharmacy
d. failed to take any, or any adequate, steps to ensure that dispensing systems and practices put in place by another pharmacist were both appropriate and lawful
e. failed to follow the Pharmacy’s established Standard Operating Procedures
f. failed to check the Patient Medication Records in the Pharmacy prior to dispensing the said prescription only medicines
g. caused, allowed or permitted prescription only medicines to be supplied to residents of Hollybank which were incorrectly labeled.
3. That as a result of the matters alleged at 1 and 2 above, whether taken individually or cumulatively, he intentionally or recklessly endangered patient safety.

The Statutory Committee of the Pharmaceutical Society will sit at 73 University Street Belfast BT7 1HL on the 27th of October 2010 at 10.00 am, for the purpose of making Inquiry into the case regarding Mr. Michael Scullin a pharmacist registered with the Society, registration number 3995.
It is alleged[1] that he;
- Whilst working as a Pharmacist on three occasions between the 12th of May 2009 and 19 August 2009, dispensed to the same patient a medicinal product, namely furosemide, other than in accordance with a prescription, in contravention of Section 58 of the Medicines Act 1968.
- Failed to take proper or adequate steps to contact the prescriber to confirm whether the patient should still have had furosemide dispensed.
- Allowed and permitted the patient to take medication that had been specifically discontinued by his general practitioner due to health concerns, namely an electrolyte imbalance.
- Failed to comply with the principles of the Pharmaceutical Society of Northern Ireland's Code of Ethics and Practice and with associated obligations;

On the 13th day of May 2010 at 10.00 a.m. the Statutory Committee of the Society will sit at 73 University Street, Belfast, BT7 1HL for the purpose of making inquiry into alleged misconduct regarding Mr. Derek Webb and his application to be restored to the register of pharmaceutical chemists.
It is alleged that:
- The pharmacy had prepared and then supplied an unlicensed teething mixture;
- Mr Webb had pleaded guilty and been convicted of offences namely
- Breach of the Medicines (Advertising) Regulations 1994;
- Breach of the Medicines for Human Use (Marketing Authorisations Etc) Regulations 1994 in the placement on the market of a medicinal product which did not have a Community or United Kingdom Marketing Authorisation in respect of that product;
- There was a failure to comply with the relevant legislation, the principles and associated obligations of the Pharmaceutical Society of Northern Ireland’s Code of Ethics.
Subject to the provisions of the Pharmacy (Northern Ireland) Order 1976 the Statutory Committee will meet making inquiry into these matters and may direct that Mr. Derek Webb shall not be restored to the register of Pharmaceutical Chemists in Northern Ireland.

It is alleged that on 30 September 2008 whilst working as the Pharmacist at the Pharmacy at 12 Merville Garden Village, Newtownabbey that in contravention of Section 58 of the Medicines Act 1968 he dispensed a medicinal product other than in accordance with a prescription causing, allowing or permitting a patient to be dispensed with the wrong medicine;
Furthermore in doing this he failed to comply with three principles of the Pharmaceutical Society of Northern Ireland's Code of Ethics and Practice;

On the 14th day of November 2008 at 10.00 a.m. the Statutory Committee of the Pharmaceutical Society will sit at 73 University Street Belfast BT7 1HL for the purpose of making Inquiry into the case regarding Ms Roisin McKenna previously registered with this Society [Former registration number 3756 R]
The details of this case being that any future fitness to practise by Ms Roisin McKenna may be impaired by reason of prior misconduct while being a registered pharmacist. This misconduct resulted in Ms Roisin McKenna receiving a number of criminal convictions.
Subject to the provisions of the Pharmacy (Northern Ireland) Order 1976 and due process the Committee may direct that Ms Roisin McKenna may or may not be restored to the register, or may or may not be restored until the Committee otherwise direct.
